内容記述 Effective dispute resolution plays a vital role in maintaining the public’s trust in e-commerce. Unfortunately, the distinctive characteristics of Cambodian e-commerce, involving the prevalent use of social media as the online marketplace, have resulted in the absence of an internal complaint system for consumers. In addition to the insufficient existing redress options, the requirements set forth in ASEAN require Cambodia to have an effective mechanism for e-commerce dispute resolution. This thesis thus utilizes a comparative legal approach to explore the implementation of Online Dispute Resolution (ODR) in the United States (US) and the European Union (EU) and evaluate its feasibility for handling e-commerce disputes in Cambodia. Notably, under the self-regulatory approach, the US allows e-commerce marketplaces such as eBay to incorporate ODR systems within its platforms. eBay Resolution Center, an early example of ODR, employs online negotiation tools to facilitate the settlement between consumers and traders through preset templates. In contrast, the EU utilizes the state regulatory approach by launching the EU ODR Platform as an intermediary for consumers and traders to lodge complaints and connecting disputing parties with certified ODR providers for dispute resolution. ODR in both systems indicates the effectiveness of the ODR system in resolving e-commerce disputes due to the ease of the online negotiation tools’ procedures. Considering Cambodia’s status as a developing country with limited technological advancement and digital literacy of the public, this study proposes adopting a government-supported ODR system, which aligns with the ASEAN Guideline on ODR, as a centralized hub for the public to resolve consumer disputes. This system should feature easily-navigated ODR procedures and external support to guide the public in using the ODR system when resolving disputes.
