| 内容記述 | Since the right of indigenous peoples to self-determination was recognized in the Indigenous Peoples Declaration in 2007 at the United Nations, the trend in the international community has changed significantly. In Japan, the National Diet recognized the Ainu people as an indigenous people, but their indigenous rights are not recognized in the Act on the Promotion of Ainu Culture, and Dissemination and Enlightenment of Knowledge about Ainu Tradition, etc., and only national encouragement of cultural promotion is pursued as a Japanese policy. In this context, the Ainu people have increasingly filed lawsuits seeking the realization of their rights. This paper examines the Nibutani Dam case and the recent Rapolo Ainu Nation case which related to the rights of the Ainu people, and argues that not only the right to cultural enjoyment as stated in the Japanese Constitution should be respected, but also the Ainu people’s right to self-determination should be recognized at first and foremost. | |||||||||
