内容記述 Though administrative litigation in Uzbekistan binds standing requirements (legal qualification to seek judicial review) to the legal interest concept (interests that a law intends to protect), it lacks a consistent test for determining the latter. This inconsistency causes overly restrictive or excessively extended interpretation of the plaintiff’s standing in practice. This study, therefore, addresses the following research question: how should administrative courts in Uzbekistan identify the content and scope of the legal interest in a concrete public dispute? This prescriptive research aims to analyze how to pinpoint the content and scope of the legal interest within the context of administrative law by applying an Uzbek case study and archival analysis of the Code of the Republic of Uzbekistan on Administrative Proceedings and related papers. Furthermore, this analysis compares Uzbekistan with Japan to uncover and explore feasible insights from the latter regarding the raised issues. For instance, the Japanese Administrative Case Litigation Act provides structured guidelines for the legal interest test by stipulating four consideration factors. Japanese judges consider the purpose of the governing law and related legislation, the content of the plaintiff’s damage, and the degree of this damage in determining legal interests. Due to these consideration factors, third parties have a high level of access to justice, and the system protects initial beneficiaries from redundant legal proceedings that only seek formal legality. Since a standing requirement is identical in both jurisdictions, the legal theory of Japan may be fruitful for enriching the understanding and interpretation of the same provision in the Uzbek code. Therefore, this thesis argues that Uzbek judges should employ the Japanese legal interest test (which consists of four consideration factors) to determine the content and scope of legal interests in public disputes. The analysis will include evaluated evidence showing that this solution can expand third-party access to justice, ensure the predictability of the judiciary, and standardize the application of standing requirements in Uzbekistan’s administrative litigation.
