| 内容記述 | This research examines how social norms and institutional frameworks shape the Supreme Court of Japan’s constitutional interpretation of equality in family law, particularly under Article 750 of the Civil Code. The study argues that constitutional adjudication is not a purely normative but a socially embedded process influenced by the legacy of the household ideology, the family registry system, and gendered social roles. Through doctrinal and discourse analysis of the Supreme Court’s landmark decisions on the same-surname system in 2015, 2021, and 2022, the research offers insight into how judicial reasoning may reflect and reproduce these underlying norms A comparative analysis of Austrian constitutional jurisprudence presents a contrasting model of review, in which equality in family law is treated as a judicially enforceable standard rather than primarily a matter of legislative discretion. Whereas the Austrian Constitutional Court required legislative reform to give effect to equality, the Supreme Court of Japan has consistently framed the surname requirement as a policy issue for the Diet. Consequently, judicial interpretation in Japan has narrowed the practical scope of constitutional protections relating to individual dignity and equality in marriage and family law. The study concludes that the Court’s persistent deference to the legislature, despite sustained legislative inaction in this area, contributes to the perpetuation of inequality and limits the accommodation of diverse family structures. A recalibration of constitutional interpretation that gives greater weight to individual dignity and substantive equality within family law would be necessary to ensure that constitutional guarantees function effectively in light of contemporary social realities. | |||||||
